Terms of Service

These Terms of Service ("Terms") govern your use of Klerance ("the Service"), operated by Klerance ("we", "our", or "us"). By using our Service, you agree to these Terms in full. If you do not agree, do not use the Service.

1. Service Description

Klerance is an AI-powered compliance checking tool that validates commercial invoices against UAE free zone customs requirements, including JAFZA, DMCC, and Dubai South. The Service identifies potential documentation errors before you submit to customs authorities.

Each compliance check costs AED 99. Payment is processed through Paddle.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. See Paddle's Checkout Buyer Terms for details.

2. Important Disclaimer

This tool provides guidance only and does not constitute legal or customs advice.

Klerance provides compliance guidance based on publicly available regulations as of the verification date shown. Regulations change without notice. Users are responsible for verifying current requirements with relevant authorities before submission.

3. How the Service Works

  1. You select a free zone (JAFZA, DMCC, or Dubai South) and upload a commercial invoice.
  2. Our AI analyses the document against the selected free zone's requirements.
  3. You receive a summary showing the number of errors and warnings found.
  4. After payment of AED 99, you receive the full compliance report with specific findings and fix instructions.
  5. You also receive bonus resources: a Free Zone Requirements Cheat Sheet, a Pre-Submission Checklist, and a Sample Compliant Invoice.

4. Acceptable Use

You agree to:

  • Upload only documents you are authorised to share
  • Use the Service for legitimate customs compliance purposes only
  • Not attempt to reverse-engineer, scrape, or abuse the Service
  • Not upload malicious files or content
  • Not exceed reasonable usage (we reserve the right to rate-limit excessive use)

5. Payment and Refunds

Each compliance check is a one-time purchase of AED 99. Payment is processed securely through Paddle, the Merchant of Record. We do not store your payment card details.

Digital Content & Right of Withdrawal

The compliance report is digital content that is delivered immediately upon payment. By completing your purchase, you consent to immediate delivery and acknowledge that you lose your statutory right of withdrawal once the report has been delivered. This is in accordance with applicable consumer protection laws, including EU Directive 2011/83/EU, Article 16(m).

Refund Policy

Despite the digital content waiver above, we offer a voluntary 14-day satisfaction guarantee. If you are not satisfied with your compliance report, you may request a refund within 14 days of payment.

To request a refund, email support@klerance.com with your purchase details. All refunds are processed by Paddle using the same payment method as the original transaction, within 14 days of the refund being approved. Refund requests are subject to Paddle's fraud and abuse checks.

Re-check Policy

You may re-check the same document at no additional cost within 7 days of your original purchase, provided you use the same email address.

6. Miss-Nothing Guarantee

Found an error we missed? Full refund. No questions asked.

To submit a guarantee claim, email support@klerance.com with the subject line "Guarantee Claim".

7. Data Handling

Uploaded documents are processed in memory and deleted immediately after your compliance report is generated. We do not retain copies of your invoices. For full details, see our Privacy Policy.

8. Compliance Data Accuracy

Our compliance rules are based on publicly available regulations from Dubai Customs, JAFZA, DMCC, and Dubai South. Each compliance report shows the date our rules were last verified.

Customs regulations can change without notice. While we make every effort to keep our rules current, we cannot guarantee that our data reflects the very latest regulatory changes. You should always verify requirements with the relevant authority before final submission.

9. Limitation of Liability

To the maximum extent permitted by law:

  • The Service is provided "as is" without warranties of any kind, express or implied.
  • We do not warrant that the Service will be error-free or uninterrupted.
  • Our total liability for any claim arising from your use of the Service is limited to the amount you paid (AED 99 per check).
  • We are not liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to customs delays, fines, penalties, storage fees, or lost business.

10. Intellectual Property

The Service, including its design, features, and content (excluding user-uploaded documents), is owned by Klerance. Compliance reports generated by the Service are licensed to you for your personal or internal business use. You may not resell or redistribute the reports.

11. Modifications to Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the Service after changes constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of the United Arab Emirates. Any disputes arising from the use of this Service shall be subject to the jurisdiction of the courts of Dubai.
